In its own mind, the SEC believes it is winning and has no strong reason to settle. I do think the emails are more damaging than John believes, but again, SEC believes those won’t get out publicly. The people have to force the SEC’s hand, hence @hodl_law#ETHdec lawsuit!

SEC is “winning” in the sense that it has mainly won all other crypto lawsuits to date. It is not winning in the Ripple case (objectively IMO), but it also hasn’t suffered a case-altering loss…yet. Until it is forced to smell it, SEC will continue to thank it **** don’t stank.
